Aaj is post mein aap sabhi ko Bank loan se jude aap ke un adhikaro ke bare mein batane ja raha hu, jinki janakri har us vyakti ko honi chahiye jo bank se loan lene ja raha hai ya jisne bank se loan le liya hai aur time par us loan ki bharpai / adayegi nahi kar paa raha hai.
To jis bank se apne loan liya hai wah bank aapse apni marji se aapke sath kuch nahi kar sakti hai.
Bank ke pass apna pura adhikar hai, ki wah logo ko loan de sakta hai, to uski recovery bhi karne ka pura adhikar hai.
Jab bank loan deti hai uska bhi pura process follow karti hai, ussi prakar jab bank ko loan ki recovery karne ke liye bhi ek process ko follow karna hota hai.
To chaliye jante hai Yadi aapne bank se Loan liya hai aur time par Loan pay nahi kar pa rahe hai, to aise mein apke pass kya adhikar (Right) hai.
Kyoki hum aap sabhi logo ko apni is puri life mein kabhi na kabhi loan ki jarurat hoti hai, aur uske liy hum loan ke liye bank mein apply bhi karte hai, bank apni formalities puri karti hai fir loan ka approval karti hai.
Loan kya hota hai ?
Bank Loan wah loan hota hai jiske liye hum ap sabhi bank mein apply karte hai, bank dwara humse loan lene ki wajah puchi jaati hai, aur bank ke dwara loan approval ke liye mangi gayi jankari aur document ke aadhar par bank loan ka approval karti hai.
Loan kab liya jata hai ?
Loan bank se kisi bhi vyakti ke dwara liya ja saka hai, lekin us vyakti ko bank ki loan Term & Condition ko pura karna hota hai. Har vyakti ki apni- pani alag -alag jarurat hoti hai, ussi ke aadhar par har vyakti bank se loan leta hai.

Jante hai Bank Loan time par na chuka pane par Aapke pass kya adhikar hai ?
1. Notice ka adhikar ( Right to Notice)
Yadi aapne bank se Loan liya hai aur time par us loan ki adayegi nahi kar paa rahe hai, to aise mein bank us Loan ki recovery ke liye aapke dwara apki property par apna adhikar lene se pahle bank apni process ko follow karta hai aur aapko kuch time deta hai ki is time period ke bhitar aapne jo bank se loan liya tha uski recovery kar de.
( SARFESI)- Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act , is adhiniyam ke tahat har bank wale apne loan ki recovery ki process karte hai.Agar karjdar ke account ko ( NOP) Non Performing Assest mein daal diyagya hai aur karjdar ke dwara 90 dino ke bhitar mein loan ada nahi kiya jata hai, to aise mein Bank ke dwara 60 dino ki Notice di jaati hai us vyakti ko jo karjdar hai.
Yadi in 60 dino ki Notice ke bhitar karjdar bank loan ki adayegi nahi kar pata hai , to aise mein bank ko yah pura adhikar hai ki wah karjdar ki property ki nilami kra kar bank ka loan amount recover kar sake.Bank dwara jab nilami ke process ko shuru karta haito ussay pahle bank 30 dino ki public notice deta hai. Is notice mein bank nilami ke bare mein batata hai.
2.Sune jane ka adhikar (Right to Hearing)
Jab karjdar bank ke loan ko time par ada nahi kar pata hai, to usko ek notice di jati hai ki wah 60 dino ke bhitar loan ko ada kar de. Notice period ke time karjdar Authorize Officer ke samne pani baat ko rakh sakta hai. karjdar dwara yah objection kiya ja sakta hai, ki bank uski property ko jabt na kare. 7 dino ke bhitar officer ko is objection par apna jawab dena hota hai. Yadi officer ke dwara karjdar ke is objection ko kharij kar diya jata hai, to aise mein us officer ko iska aadhaar bhi batana hoga.
3. Manviya vyavahaar ka adhikar ( Right to human behavior).
Har bank ka apna ek recovery agent hota hai, jo ki bank loan ki karjdar se recovery karte hai.Yah asha ki jaati hai ki ye agent karjdar se accha vyavahar karenge. Bank agent ke bad behavior ke kai mamle samne aye aur RBI ne bank ke is behavior par action liya.
- Agent karjdar se uske sthan me milega.
- Yadi karjdar ka nischit stah nahi hai, to aise mein agent karjdar ke nivas stah ya karya-sthal mein khud ja kar milega.
- Agent karjdar ki nijta ki respect aur accha vyavahaar karega.
- Agent karjdar ko kewal Morning mein 7 baje se lekar evening 7 baje tak hi call kar sakta hai.
- Agent karjdar aur uske parivar walo par koi julm nahi karega, na hi kisi prakar ki koi dhamki dega, aur na hi apmaan karega.
4. Uchit mulya ka adhikar (Right to fair value).
Yadi aapne bank se loan liya hai aur time par aap bank loan nahi ada kar par rahe hai, to bank aapko 60 dino ki ek notice deti hai ki 60 dino ke bhitar aapne jo loan bank se liya hai usko ada kare. YAdi aap in 60 dino ke bhitar bhi bank laon ada nahi kar pa rahe hai to, bank apki property ki nilami ke process ko shuru karti hai.
Lekin bank jab aisa karti hai, to issay pahle wah karjdar ko ek notice deti hai.Is notice mein bank karjdar ko uski property ki uchit mulyankan ke bare mein batata hai. Bank ke Valuer dwara decide ki gyi Amount, Reserve price, Nilami ki date aur time ke bare karjdar ko jankari deta hai.
Yadi karjdar ko yah lagta hai ki uski property ka amount bank ke valuer dwara uchit nahi decide kiya gya hai, to aise mein karjdar objection kar sakta hai.
5. Property ki nilami ke baad baaki amount ka adhikar .(
Jab karjdar banki ke dwara notice diye jan ke baad bank loan ada nahi kar pata hai to aise mein us karjdar ki property ki nilami kar ke bank apne loan ki recovery karta hai. Agar property ki nilami ka amount loan aur nilami ke process par hone wale kharche se jada hota hai, to baaki ke amount par us karjdar ka adhikar hota hai.
Jaise maan lijiye bank ka aap par total 50,0000 rs ka bakaya hai. Nilami aur other process mein 10,0000 rs ka kharch hota hai.dono ko milakar 51,0000 rs hota hai. Agar property 60, 0000 lakh mein bikti hai, to aise mein baaki ka amount 9,00,000 lakh karjdar ko wapas kiya jayega.
